Washington State has this moronic law from the early days for settlement purposes. Way back in the 1800's you could move onto land that did not appear occupied. In 7 years even if owned/claimed by someone else, if the claimant/owner does not appear in that time frame, or objects to the occupation attempts to remove the trespasser. The land can be taken by the trespasser. Brief description of adverse possession:

Circumstances of the adverse possession determine the type of title acquired by the disseisor, which may be fee simple title, mineral rights, or another interest in real property.

The law of adverse possession is partly statutory and partly common law. The required period of uninterrupted possession arises out of a statutory limitation period or statute of limitations. Other elements of adverse possession are judicial constructs.


We own some land that one of our neighbors started using and improving an old shed building on. Along with building a chicken pen and then asked for permission by pointing out their trespass. Spent two years trying to get an agreement and or have them purchase the parcel. I have no real need for this under an acre portion and have been accommodating, along with neighborly, not making waves, etcetera. One thing led to another and this a$$hole made the threat of adverse possession. Sent them a legal notice to vacate and their attorney shot back a nasty not very well put together letter. So know I'm not pleased. Plans of pig farms next door to them and maybe a trailer park. They are messing with the wrong people on this one. Have the means to play ball in a legal sense and will use every inch of legal means to stop this attempted theft from very in my opinion scum low class pieces of trash.

Bob, that's unbelievable. But I guess it proves the adage that 'no good deed goes unpunished'.

The thing is, with a character like this guy, even if you win you're stuck with a neighbor who is going to be a pain in the neck.

Its hard to explain how some people live their lives. Good luck with the case, I hope you get a commonsense judge.

Lucky for Me that I live in another area of town. Have rented out the house with that property. We also have a neighborhood water board/association, his wife sits on the board of directors. The law firm I use also does work for the water district. So they have a conflict of interest and cant rep either of us. So I'm seeking out a new firm this week. Despite Washington States rep as being liberal, my county is very conservative.

Been busy with a new business project. Legal issue is basically Me and their attorney writing letters back and fourth. Last one was a bit arrogant on my part. Funny though. "Id advise your clients to find much better more suitable counsel. The only time I'll give in is when the federal Supreme Court says its over. That is not posturing. I'm 35 single with no financial obligations except to my self. I will sell every asset and use every penny of mine available to fight every step of the way. Either vacate immediately or file suit."

I don't like suing. Its easier to defend.
